Carrier AT&T insurance policy

so I have the mobile protection plan and ended up breaking my phone, and losing it but when my mom called AT&T she only told them that I broke it. I just received the new phone today and was wondering what to tell the people at AT&T. is your old phone required to be sent back? will I be penalized for not having it
