I have 2 xs max and would like to consolidate to 1. Can i do a iCloud backup and download this information on my other max without losing the information on that phone? Basically merge 2 into 1?

No. To restore from a backup, you have to reset the phone which of course wipes everything currently on it.

If you want to combine the two, back up the primary one and then copy the data off the other one to somewhere else, then copy it back to the primary one
